MAIN FUNCTION

Tambunan District office acts as the chief coordinator to all development activities at District level and represents the State Secretariat and the Federal government at the District level. The long term objectives are in line with the New Economic Policy that is to eradicate poverty and restructuring the community. The main objective to be achieved by the District Office are as follows:-

  1. To modernize the living standard of the rural people.
  2. To provide basic amenities.
  3. To create job opportunities
  4. Community development.
RESPONSIBILITIES AND FUNCTIONS OF THE MAIN SECTIONS.

The District Office of Tambunan consist of 4 (four) main sections as follows:-
  1. Administration and Finance
  2. Rural Development
  3. Native Court, and
  4. Land Section
ADMINISTRATION AND FINANCE

To prepare the annual expenditure estimates.
  1. To collect revenue
  2. Licence
  3. Accounts
  4. Filing
  5. Office Administration
  6. To Enforce various laws
  7. To manage Staff/personnel matters
  8. Tenders and Quotations
  9. Appointment of District Chief/Native Chiefs/Assistant Native Chiefs/Community Chiefs
  10. Security
  11. Magistrate Court
  12. Registration of voters
  13. Census
  14. To facilitate the implementation of computer systems presently used by the government i.e. SISVOT, SISFAIL, SISPHAN AND E-CUTI , SM2
  15. To maintain office vehicle and office machines.
RURAL DEVELOPMENT SECTION

The Rural Administration section consist of 3 (three) sub section i.e. Planning , Implementation and Minor projects.
  1. Planning section is responsible for development planning, at district level in line with the state development strategies. Accumulating data on socio economic and preparing District Basic map . The main function of this section is to plan District development projects based on accumulated data including Malaysia Five year Plan. This section is also responsible to update information in the data bank and the District Development Plan and also acts as the secretariat for the District Development Committee.

  2. The implementing section is responsible for supervising the implementation of all development projects at the district level including rural Minor Projects that is being implemented by the District office. This section is responsible to monitor the implementation of projects based on the feedback from implementing agencies from time to time and updating the data bank regarding the status of the projects.

  3. The minor project section is responsible to plan , implement and to ensure rural projects are completed successfully. Planning of projects is based on the district Development Plan that is prepared by the Project Planning Section. Projects implementation includes inviting Tenders/ Quotations, supervisions and monitoring. Data's regarding the status of the project is sent to the Implementing section to be kept in the data bank for monitoring purposes.

    Overall the main function Rural Administrations section is as follows:-

  4. Planning of development projects
  5. Integration of development activities and reports regarding development projects.
  6. To control and inspect the progress of Rural Minor projects.
  7. To administer the Village Development and Security Committee.
  8. To update data's in the operation room
  9. To plan and implement poverty eradication programme and update data's regarding household of hard core poor.
  10. To coordinate poverty eradication programme planned by other agencies.
  11. To prepare documents for MS ISO 9000 certification.
  12. To prepare five years district development plan.
  13. To coordinate District Economic Development
  14. To plan district development plan
  15. Planning human resource development including registering of job seekers and coordinating training courses.
COURTS

This section comprise of 2(two) sections namely :-
  1. Magistrate Courts
  2. Native Courts
  3. Magistrate Courts.
Magistrate court is being manned by a clerk. All court proceedings is done by 1st class magistrate who is based in Keningau. The main function of this unit are:-
  1. To register all civil cases , traffic, juveniles and criminal cases under the jurisdiction of 1st class magistrate.
  2. To prepare court hearings documents
  3. To issue summons to appear in court, warrants of arrest, lunatic warrants, warrants of imprisonment and remand warrants.
NATIVE COURT

This section is to ensure that the welfare and the culture of the rural communities are safeguarded. The government has appointed community leaders headed by the District Chief and assisted by Native Chiefs and Village Chiefs to judge any wrongdoings related to custom. Their main function are as follows:- Customary claims for non Muslim bumiputras ( Succession claim) Marriages Divorces proceedings Administration of Native Court Ordinances To preside over cases related to Native Custom To process child adoption

LAND SECTION

This section is headed by Land Office Supervisor which is directly under the Land and Survey Department. The District Officer and Assistant District Officer ( Administration) acts as an Assistant Collector of Land Revenue. The main duties of this section are as follows:-
Processing of Land applications

  1. To process Land Acquisition
  2. To process change of ownership, Mortgage and Land ownership surrender.
  3. To process Land Enquiries
  4. To register land title( NT/FR)
  5. To process land succession applications
  6. To process Temporary Occupation License( TOL)
  7. To collect land revenue.
  8. To process gazette of state land.


THE DUTIES OF THE DISTRICT OFFICER

The role and the function of the District office is reflected by the duties performed by the District Officer that includes the following function:- General Administration and Finance Revenue Collection Accounts Office Management Personnel Ceremonial and Protocol Security Tenders and Quotations Maintenance of Stores

RURAL ADMINISTRATION

Administration of Village Security and Development Committee Planning of Rural projects Integration of development activities and progress report on minor rural projects. To control and supervise the progress of the implemented rural minor projects.

POVERTY ERADICATION

Accumulating data's on household of hardcore poor
  1. To plan activities to eradicate poverty
  2. To ensure the successful implementation of GDW
MANAGEMENT OF HUMAN RESOURCE

To register job seekers and to prepare statistic on job seekers in the district. To coordinate career training for job seekers.

LAND ADMINISTRATION

The District Officer and Assistant District Officer( Admin) act Assistant Collector of Land Revenue at the district level to enforce the following:-
  1. Land Ordinance Cap.68
  2. Land acquisition ordinance Cap.69


ADMINISTRATION OF LOCAL AUTHORITY

The District Officer also act as the Chairman of the District Council to enforce the following laws:-
  1. Various By Laws Majlis Daerah
  2. Standing Orders Majlis Daerah
  3. Local Authority Ordinance
  4. Town Planning Ordinance CAP.41


MAGISTRATE COURTS

The District Officer and Assistant District Officer ( Admin/Rural ) acts as "Ex-Officio Second Class Magistrate" to perform the following duties:-
  1. To preside over minor offences cases
  2. To sign Remand Warrant
  3. To sign Warrant of Imprisonment
  4. To sign Lunatic warrant
  5. To attest or to certify Statutory Declaration, agreements and other documents.


RURAL ADMINISTRATION

The District Officer perform the duty as Deputy Chairman and Assistant District Officer ( Rural) as the Secretary of the Rural Administration Committee responsible for the appointment of District Chiefs, Native Chiefs, Assistant Native Chiefs and Village Headman.

ADMINISTRATION OF NATIVE COURTS

The District Officer preside over appeals from native courts and examines decisions by Native Courts in accordance with Native Court Ordinance Cap.86

LICENSING

The District Officer and the Assistant District Officer (Admin) perform the duty as a Licensing officer to approve and issue the following license:- Trading license

Liquor license ( Subject to approval by Excise Licensing Board, in accordance with Excise Act 1976)

REGISTRATION

The District Officer acts as the Chairman of District Marriage Tribunal.

ELECTION OFFICER

The District Officer acts as Deputy Registration Officer for P 157 Keningau ( Registration of New Voters ), Returning Officer for N 27 Tambunan( State Election) and Assistant Returning Officer for P157 Keningau ( Parliamentary Election ).

CENSUS

OTHER FUNCTIONS

The District Officer is also responsible to enforce the following laws.

  3. Road Vehicle Ordinance
  4. Definition of Native Ordinance
  5. Administration of Natives and Small Estates Ordinance Cap 1.
  6. Auctioneer Ordinance Cap. 9.
  7. Agricultural Pest Ordinance Cap .4.
  8. Burial Ordinance Cap 19.
  9. Cattle, Grazing and Pounds Ordinance Cap 31.
  10. Akta Kawalan Bekalan 1961
  11. Adoption Ordinance, and
  12. Law Reform ( Marriage and Divorce) Act 1976.
LEADERSHIP

The District Officer is the Organizing Chairman of all District's Official Functions .

CONCLUSION

The functions and roles of the District Officer has increased due to the following factors:-
  1. Increase in work load.
  2. Increase in the population
  3. Re delineation of the Election boundary has increased the activity and administrative duty in social economic development.
  4. Creation of new government agencies.

Creation of new government agencies or expansion of existing government agencies has increased the responsibility the District Officer since new agencies will require guidance from District Officer.
